Here's the first television interview of the 9 billion dollar Chase whistle blower Alayne Fleischmann. She was a lawyer for Chase who saw the evidence of fraudulent securtized trusts being set up by Chase first hand. What happened in Chase happened in Countrywide, Bank of America, CitiGroup, Wells Fargo and tons of other banks. The servicers and trustees in these things were active participants and accomplices. This is probably the biggest Conspiracy theory of them all since it involved THE WHOLE lending industry. They knew they were breaking the law and willfully did it.
And MERS is what allowed all this to happened. MERS is what allowed all the mortgages to be shredded and split up. Fortunately like you and I have both said, they didn't follow their own laws and can be busted for it.
Unfortunately they got busted for harming investors, title insurance companies, the government, and threw the leftovers to "the People". The banksters only had to pay pennies on the dollar for their crimes. I think it's time "the People" get paid back some money.
The banksters stole money by committing the original fraud, then "the People" bailed them out. They made these fraudulent mortgages (illegal & non-mortgages) and then bet against them and collected money through the insurance they bought on them. Then they gave themselves big bonuses out of the bailout money and started taking homes back illegally through robo-signing (forgery) since they never did the original paperwork they were supposed to do and didn't have the original wet ink mortgages, (Show me the note argument) because they were shredded or lost. Then they start the fraud all over again.
One thing about MERS is that it supposedly allows the banksters to not have to record each change in ownership in the mortgages, because the mortgages were recorded in MERS' name. But when you go to your county mortgage recording office you'll see the mortgages were recorded in the original lender's name, not MERS. ;-) So they didn't even follow their own new laws they supposedly created without it being legal.
Like the case with my mortgage, the securitized trust my mortgage is supposed to be in, was basically shut down within months (From June 2005 - Feb. 2006) of it being created because the banksters didn't legally put the mortgages in the trust. The trust are empty and basically shut down, yet continue to demand payment, which is theft. This is the case for most securitized mortgages, which is most mortgages.
So a few options for all this is to sue your "investor/note holder", along with your servicer and MERS for all the fraud and theft. Another option is to set up meetings with your state representatives and senators, and expose the fraud to them and show them what is really going on, and demand they pass laws to stop it all. You can also go to the Attorney General in your state who is supposed to protect the People from consumer fraud, and demand they do their job. If they refuse, you sue them and demand their recall for violating their oath of office. (One person can do that by the way, if you can prove malfeasance and so on) And I just found a law yesterday(11 U.S.C. § 303) that allows three or more persons to forcibly bankrupt these crooksters. The other option is let them to continue doing this again until they bankrupt themselves and this country, because the "government" is not doing anything about screwing "the People".
Anyway, here's the interview. And notice Eric Holder is FULLY aware of what these crooks did, and did nothing about it since it's too hard to prove (yeah right)and they're "too big to fail". (Same response) The country and the People" aren't too big to fail?
