Looks like he's getting them for illegal search and seizure of his person. Unwarranted and unreasonable intrusion. That the x-rays are an unwarranted strip search which can be recorded. And that repeated x-rays can cause among other things skin cancer. The searches violate his right to privacy and are basically a sexua| assult on him. And that the house of representatives asked TSA to reconsider their policy and that TSA should allow a trusted traveler program which the government suggested, and that members of the government and airline pilots are not subject to these searches. And that to continue doing his show, this may subject him to cancer and be bad for his health. And that all this violates his 4th amendment rights.
He claims the injury is to his 4th amendment rights and health.
The relief he asks for is no further 4th amendment rights violations, court and attorney costs and anything else the court deems reasonable.
He is trying to go the classic route. Establish there was a duty, the duty was violated, who did the violation and that they directly were responsible, and the relief.
He didn't mention Janet Napolitano and John Pistole in the violations, yet they are the defendants. Mistake in my opinion. He's taking them to court in their official capacity, which may be why he's not suing for money. Both mistakes in my opinion.
Sounds like the only thing he will win, is being able to be on the safe traveler list and avoid being searched. But hopefully it will open the door further for others to get them on the 4th amendment violation and stop this illegal garbage. I didn't look where he filed this. Hopefully a lower court will rule against this. But the government will probably appeal like the Arizona borders case. It would seem 4th Amendment stuff would wind up in the supreme court, but who knows. They'll probably try to stall as long as possible and drain Jesse of all his money?
